Nebraska Governor Uses Need for Mental Health as an Excuse to Promote Guns and Deny Immigrant Children Homes

Greetings, Governor P. Ricketts,

Recently you denied the President's request to help immigrant children and said those resources are needed for the state's own foster children and youth in rehabilitation programs. The next day you pledged to protect guns and said that restrictions were a bad idea and we just need to up mental health care.

If you ACTUALLY believe any of this, when are you announcing a huge initiative to make mental health resources and access free to ALL residents of Nebraska? 

I'll wait.

Oh dang, I waited so long for your mental health care initiatives, it looks like hell froze over in the meantime. 

Be honest (if you know how.) You have ZERO intention of addressing mental health in this state and are using it as an excuse and bald-headed lie so that you can dog-whistle to your base in your discrimination against immigrants and your protection to guns, guns, guns, (which are less regulated than wombs in Nebraska).

When in fact, everyone in Nebraska DOES need access and resources to mental health care and it WOULD help tremendously if you had the gall to do something about it, instead of just using it as an excuse to do or not do something.

But in order for these mental health resources to be effective, you also need to address the issues that are at the heart of the difficulties that cause people mental anguish. Here are a few I can think of at the moment: 

  • medical costs that bankrupt (Universal Health Care would solve that)
  • finances (raise the state/federal minimum wage to a living wage comparative to what it should be with inflation. $15 is a start, but should be more like $20+)
  • child care, maternity & paternity leave 
  • police brutality (hi, did you not just see 15 cases lumped together in Omaha and dismissed to let cops get away with shit like murdering people? That isn't justice. And body cam footage is supposed to be for the people to hold cops accountable, not for cops to hide behind new rules.)
  • The inequity for housing, school districts, etc. The list goes on and on.
So, if you want to deny immigrant children a place to live because you have racism and xenophobia on the brain (thought you were so pro-life, dude), and if you pander to gun-nuts because you want to make sure they don't point their guns on you, that's on you and your conscience. I judge you for it. You shouldn't be in public office because you don't serve the people. I also judge you for using the need for mental health as a reason for your bad calls when you have ZERO intention of doing anything about it. 

You should be ashamed for lots of reasons, including the concept that if this state honestly can't handle a few more children and caring for their mental health, we're a lot worse off than we should be and you should leave office and let some capable people that give a shit about the people of Nebraska step in and do the work you aren't willing to do. 

But I suppose you can always just make another prayer proclamation or else something else useless, like don a cowboy hat and lie about medical marijuana.

LINCOLN — Nebraska Gov. Pete Ricketts on Tuesday rejected a request from the Biden administration to house displaced migrant children in the state.

Ricketts’ rejection comes five days after a fellow Republican, Iowa Gov. Kim Reynolds, announced a similar denial. Both governors said it was Democratic President Joe Biden’s “problem,” and he should deal with it.

“President Biden has created an immigration crisis on our border with thousands of unaccompanied migrant children coming to our country without their parents or family,” Ricketts said. “Nebraska is declining their request because we are reserving our resources for serving our kids.”

“I do not want our kids harmed as the result of President Biden’s bad policies,” the Nebraska governor added.

Last month, the U.S. government picked up nearly 19,000 children traveling alone across the Mexican border. It’s the largest monthly number ever recorded, though Biden has said there have been similar surges in the past during the early spring.

“Sponsors” for the children, usually parents or close relatives already living in the U.S., are sought so the children can live with them while pursuing asylum cases in heavily backlogged federal immigration courts.

The huge increase in the number of children traveling alone — some as young as 3 — and families has severely strained border holding facilities, which aren’t supposed to hold people for more than three days but often do. It’s left the government scrambling to find space and hire staff to care for children longer term until they can be placed with sponsors.

Lazaro Arturo Spindola, executive director of the Nebraska Latino American Commission, said Tuesday that unaccompanied children coming to the U.S. dates back to the 1960s, when more than 14,000 children from Cuba came to the country via “Peter Pan” flights.

Spindola said the governor’s announcement “basically lacks a logical reason and humanity,” and repeats talking points of the Republican Party.

An official with Nebraska Appleseed, a Lincoln-based advocacy organization for the poor and immigrants, said the border surge was “cyclical” and is a crisis not for the U.S., but for the children and families seeking safety.

“We have the capacity and knowledge to coordinate an effective humanitarian response. The United States is capable of welcoming with dignity children, families, and adults seeking safety,” said Darcy Tromanhauser, immigrants and communities program director at Nebraska Appleseed.

Ricketts said that the Biden administration should work with Central American governments to “reunite the children with their families in their home countries instead of pursuing the risky strategy of scattering them across the United States.”

When asked what harm would come to Nebraska’s children, Ricketts provided this statement to The World-Herald:

“Nebraska is not positioned to provide the proper supports relative to the necessary trauma-informed care, wraparound services and housing that displaced migrant children would need,” he said. “Taking on this crisis, which was created by President Biden, would also shift Nebraska’s focus away from managing our foster care system and Youth Rehabilitation and Treatment Centers.”

Gov. Ricketts designates Nebraska as 'sanctuary state' for gun rights

LINCOLN — Doubling down on his pro-gun rights credentials, Gov. Pete Ricketts signed a symbolic proclamation Wednesday designating Nebraska as a “Second Amendment Sanctuary State.”

The proclamation comes as President Joe Biden recently announced a plan to address gun violence.

A growing number of Nebraska counties have adopted similar “sanctuary” resolutions. A bill also is pending in the Nebraska Legislature to allow counties to opt out of the state requirement that gun owners register and take a gun safety course to carry concealed weapons.

“The White House and U.S. Congress have announced their intention to pursue measures that would infringe on the right to keep and bear arms,” Ricketts stated in the proclamation. “Nebraska will stand up against federal overreach and attempts to regulate gun ownership and use in the Good Life.”

“Second Amendment sanctuary” refers to a declaration that a state, county or city will not enforce federal gun laws they consider to be too restrictive. At least four states, including neighboring Kansas and Wyoming, have declared themselves “sanctuary states.”

In Nebraska, at least 50 counties, including Buffalo, Hall, Platte and Gage Counties, have passed sanctuary resolutions in recent months, and similar measures are being considered in at least seven other counties, according to the Nebraska Firearms Owners Association.

Biden recently announced plans to ban the sale of so-called “ghost guns,” which are firearms that can be assembled with kits and cannot be traced by law enforcement. He’s also asked the Justice Department to draft model “red flag” laws that states could adopt. Red flag laws, like one enacted in Colorado, allow judges to order the confiscation of guns from someone who is exhibiting mental health issues or threatening behavior. The president also wants stepped-up community efforts to discourage gun violence.

Ricketts, who also spoke at National Rifle Association’s convention in 2018, has consistently opposed steps to impose stricter gun laws, saying that better mental health care and improved law enforcement are the keys to preventing mass shootings.

A representative of Nebraskans Against Gun Violence noted that the governor’s proclamation comes one day after Ricketts refused to offer “sanctuary” to unaccompanied migrant children who are showing up at the U.S.-Mexico border in record numbers.

“This decree is meant to placate those that are avid gun rights activists while shunning children that are seeking refuge,” often from gun violence, said Melody Vaccaro of the gun-control group. “Gun violence is a public health crisis and we support serious funding of research, proven community programming, and using a combination of education, policy, and accountability to reduce (it).”

Legislative Bill 236, introduced by State Sen. Tom Brewer of Gordon and prioritized by Sen. Robert Clements of Elmwood, would give counties the power to allow “permitless” carry of concealed firearms. Currently, gun owners must obtain a state permit and pass a firearm course before being allowing to carry a concealed gun.

LB 236 awaits first-round debate in the Legislature.

Another Nebraska gun rights proposal, LB 188 or the “Second Amendment Preservation Act,” would prohibit the State Patrol or local law enforcement officials from enforcing any new federal restrictions on firearms. That bill, which did not receive a priority designation, has not advanced from a legislative committee.

Nebraska Governor Lies about Marijuana

Context: Nebraska Governor says Marijuana will kill your kids. Same governor who wanted to bring in illegal drugs for prisoner executions.

Greetings, Governor P. Ricketts,

You once again embarrass the state of Nebraska, this time by saying "marijuana will kill your kids". What IS guaranteed to kill kids is YOU and your pursuit to purchase illegal drugs for capital punishment, wasting taxpayer money. You claim to be pro-life, and say God is your judge, but you are quite fine with deciding to kill other human beings. 

Your hypocrisy aside, your statement about medical marijuana is baseless and an outright lie with NO data or statistics to prove it or make it even any bit credible. The fact that you say it doesn't make it true. Just as if a person said "P. Ricketts is a public servant who puts the public first" - it doesn't make it true and it is NOT true because data and facts can be brought up to disprove this. Facts like "P. Ricketts lies about the dangers of marijuana." 

A public servant should not lie.

A public servant should not make false claims.

A public servant should not be doing things in his own best interests.

In case you are unaware, marijuana is a natural plant. If you believe in God as you claim, God put that plant here with a purpose. That purpose is pain relief and many Nebraskans, especially those with terminal diseases, can use this to improve their lives, or make their last days more comfortable. It can also prevent people from developing opiate addictions. And, as an agricultural state, Nebraska could most definitely benefit from marijuana as a crop, so you are denying potential income to farmers. 

The fact that you are opposed to medical marijuana AND deny others from having access to it or making a decision for themselves is proof that you are not putting the public first. You are treating Nebraskans like they are your children who have to do as you say, instead of adults who YOU are to serve. 

I believe that you are likely responsible for the unjustified death of the Medical Marijuana petition. You denied the people of Nebraska the opportunity to decide for themselves. I don't have facts to prove this, but you know the truth.

Why are you so afraid? Are you afraid that decriminalizing marijuana would decrease the prison population? That maybe you'd have less people to dehumanize in the penal system? Or kill? Would you profit less from prisons that had less prisoners? Shouldn't we WANT prisons to have less people? To prove that we are rehabilitating people and preparing them for re-entry into society? Doesn't that indicate you don't have the public in mind, but your own profits?

All I know is that I can't trust my governor to the tell the truth. I can't trust my governor to put the people first. I again ask you to step down from public office because you prove time and again you are not a public servant that puts the public first.

To Unicameral State Senator: Make Medical Marijuana Legal in Nebraska in January

Greetings, Senator X, 

I have heard that in January, you will be introduced to a bill legalizing Medical Marijuana in Nebraska. I plead that you vote to make medical marijuana legal in Nebraska. 

This issue is important to me because I have a close friend with a radical neurological disease who was told she needs access to medical marijuana or she should move out of Nebraska so she can partake. Another alternative that doesn't comfort her or others is highly addictive opioids. 

While learning of the variety of people that could benefit from medical marijuana, as you can do on the Nebraskans for Medical Marijuana site, one must be touched by their stories: children facing seizures, people with cancer, and those like my friend with awful painful diseases. I think that compassion is needed and that medical marijuana can be safely produced to be a medical relief to so many people. 

This summer, during the last week of the petition to get the issue before Nebraskans on the ballot, I drove from X to Lincoln to pick up petition sheets. I had wanted to sign and hoped someone would come near enough to me so I could sign. But as I discovered, I was the someone I was waiting for.

Since you represent the people in my area, I think you will be interested to know the passion and interest that drove people to sign the petition, often times surprising me. 

Of course, since there is a pandemic going on, I made sure to wear a mask and at times, like at a dentist's office in X, I would stand outside and every single person in that building came out to sign. One women even called her daughter, a nurse, to drive into town to sign and she did so happily, noting how much we needed it. 

At the grocery store in X, I asked a person at the check-out if I could be in the store, or they'd like to sign. From behind me, I heard two voices insisting they wanted to sign. I hadn't even known they were there. Without prying, it looked to me as if those people had physical difficulties, perhaps MS or something that would have made them candidates for the relief medical marijuana offers.

I walked into an auto parts store in X, thinking I'd probably get shooed out by the two men there. Quite the opposite. The older, in his 50s maybe, said "I wish this had been around two years ago". His wife had died of cancer and could have used medical marijuana to alleviate her pain and suffering. His co-worker gladly signed and said he'd register to vote so the signature would be valid.

In my town of X, I had husband and in-laws and neighbors gladly sign, saying they don't want others to suffer. Every one at the bank signed and the bank manager said his daughter had done a school presentation on it and it sounded like a great thing to help people. He even allowed me to come to his home, so his daughter and wife could sign, as well as his son, who we encouraged to register to vote for his first election. 

Also in X, I had a couple come outside to sign safely. The man said "I'll sign for all the good it'll do me; it probably won't help me in time. I have terminal cancer." 

There were so many instances where people mentioned they were in pain or knew someone who would benefit from medical marijuana or that they figured if it helped somebody, it was a good thing to do. 

From Wednesday afternoon to Monday morning when I had to mail back the petition sheets, I collected nearly 70 signatures! I received 62 signatures from people in X county, 3 in X, 1 in X, 2 in Xand 1 in X. I visited X, X, and X, and interacted with people I wouldn't have otherwise (especially during a pandemic). 

I got a sense that people in Nebraska don't see this as a partisan issue. They see this as a health issue. They want Nebraskans to have the option to safely and legally use medical marijuana for their betterment. We never know when we will need it.

I only participated for less than a week, but I was filled with a sense that it was possible for enough people in Nebraska to say 'We want to see this on the ballot'. AND THEY DID. Nebraskans for Medical Marijuana was able to get 182,000 signatures, 110% of the required signatures, and people from ALL 93 COUNTIES! It was amazing and exciting, because I wasn't sure we had the numbers, even that week!

But then came a challenge - and whew - passed because the Sec of State said 'okay'. 

And then, what I consider an example of deceit and corruption that is present in Nebraska. A lawsuit saying that the wording of 'medical marijuana should be legal and the legislature will figure out details'... violated the 'single issue' concept. HOW? Is it so strange to say that if something is legal, WHO is responsible for the details? 

The Lancaster Sheriff who was part of what amounted to a special interest lawsuit admitted he didn't even know who was paying for the lawsuit. I don't understand why he couldn't just vote on it like everyone else was supposed to do.

And the Nebraska Supreme Court let us down big time by an improper siding with the lawsuit 5-2. Why didn't they raise an issue when they approved the petition before it circulated? Who got to them?

I view this as an example of dark money and special interests blocking progress and health care. It infuriates me. There are likely groups in the state who benefit from health insurance and pharmaceuticals who saw medical marijuana as a challenge to their pocketbooks. Because of them, Nebraskans did NOT get a chance to make their voice heard. Our voice, in the form of a constitutional petition, was stolen from us. We could have been among the states that just voted to legalize marijuana, if only for medical use. We could have been working on bettering the lives of people who are in pain before they die. But there are people promoting their own interests above those they are to serve. That is abhorrent to me. 

You, Senator X, have a chance to help these people, to listen to the people in our area who were so willing to sign. You have a chance to help my friend, my neighbors, your family and friends, your neighbors. I implore you, vote to make Medical Marijuana legal in Nebraska. Because if you do, and if you speak to your fellow senators about this and alert them it's in the best interest for those suffering in Nebraska, you can provide hope and change and relief to people you represent.

Please, don't make me go back out to get signatures again! LOL. I've already signed up to do it, but am waiting and hoping that you and other senators use compassion and do the correct thing and make Medical Marijuana legal and accessible for Nebraskans.

POSITIVE RESPONSE FROM MY LEGISLATOR NEXT MORNING :) 

X, thank you for the email, I can feel your passion. I agree that Nebraskan's should have been allowed to vote on the issue and I personally believe it would have passed. Unfortunately the petition got tossed on a technicality by the courts, one of two things must happen now. First the petitioners can start collecting signatures on a new petition that will be on the ballot two years from now (which is already happening). Second the legislature can pass a medical marijuania bill that the Governor can sign into law. I know Senator Wishart had a very good bill LB 110 that got filibustered in 2019, I will be talking to her this week to see if she is going to reintroduce it in 2021, you can also contact her office and ask them what they plan to do. You should be encouraged that our neighboring state of South Dakota passed a Medical Marijuana bill. I believe we can do this in the legislature if we write a tight well regulated bill, and if we fail, then the people will have the right to petition to put it on the ballot in 2022. Stay safe and I think it is great that you took the initiative to collect signatures in x County, it shows that you are a person that is willing to get involved to make a change.

Letter to Nebraska Supreme Court Judges re: Incorrect Ruling on Medical Marijuana Petition

Context: Nebraska had successfully petitioned to get Medical Marijuana on the November Ballot but was shut down by the Supreme Court due to a lawsuit from a sheriff and special interest groups.

Dear Nebraska Supreme Court Judges,

When I gathered signatures for the Medical Marijuana petition in my rural area, I got signatures from many caring people, people who thought that Nebraskans should get a vote, those with chronic pain or knew those who need this, a man with terminal cancer, and another man who surprised me when he said “I wish this was around two years ago” when his wife died from cancer. The people of Nebraska DESERVE the right to vote on this issue.     I’m trying to understand why the Nebraska Supreme Court approved the petition for Medical Marijuana and, after the signature effort proved 110% successful in all 93 counties, the Supreme Court found fault with the wording of the petition and stripped Nebraskans of our constitutional right to change the laws of our state.     In order for medical marijuana to be legal, there has to be a process by which to regulate it. The petition simply said it’s up to the legislature to figure that out. That is all a single issue, therefore I find the ruling incorrect and unacceptable. I don’t know why the special interest groups and sheriff who unfairly sued couldn’t have waited until it was on the ballot and voted like the rest of us were ready to do, except it seems they don’t play by the same rules as everyone else.

    This about-face feels wrong. It feels corrupt. It feels like special interest groups and people in power are denying Nebraskans rights allowed to us in our constitution. It feels like a slap in the face. It feels like a death sentence for those suffering who could have better health with access to this natural medicine. It feels like justice isn’t blind but is looking the other way.

    I don’t know how deep this corruption runs, but I recognize it’s there. And I recognize that the people in power do NOT have the best interests of ALL Nebraskans in mind. And I will continue to do anything within my rights to follow my morals and ethics to care about my fellow human beings and work for a more equitable and just world than we have before us.


To put it lightly, I am very disappointed in the political and judicial systems. To those of you who took this away from us, who stifled our voice, Judges Heavican, Freudenberg, Stacy, Cassel, Funke: what stopped you from doing the right thing? What caused you to rule against the people of Nebraska?     

    To those who dissented and wanted to fulfill the constitutional agreement and the will of the people to have this appear on the ballot, Judge Miller-Lerman and Judge Papik, I THANK YOU.

    I do wish there was something that could be done immediately to restore this measure to the ballot because two years is a long time to ask suffering and dying people to wait until we collectively can be disappointed again by seemingly-corrupt people who don’t play fair.
